Ingreso de extranjeros al país: cuáles son los nuevos requisitos
El Ministerio de Salud flexibilizó las condiciones para quienes lleguen por motivos familiares, laborales, diplomáticos o deportivos competitivos.
El Ministerio de Salud estableció nuevas condiciones para que los extranjeros no vacunados puedan acceder a la excepción de cumplir un esquema de inoculación para ingresar al país, en caso de que sean “familiares directos de argentinos o residentes en el país que viajen por motivo de visita familiar”, o quienes viajen por motivos laborales, diplomáticos o deportivos competitivos.
Así lo establece la Resolución 2948/2021 de esa cartera publicada este miércoles en el Boletín Oficial, que habilita el ingreso al país de las personas que puedan acreditar esas condiciones, sin tener el esquema de vacunación completo.
En lo que atañe a visitas familiares, la flexibilización de los requisitos alcanza a “hijos, padres, cónyuges o convivientes de argentinos o residentes”.
Las personas interesadas en acceder a esta eximición -la de contar con el esquema de vacunación completo- deberán presentar “partida de matrimonio o de nacimiento, certificación de unión civil / convivencial o certificación emitida por autoridad local que pruebe convivencia, documento nacional de identidad argentino del familiar dador del criterio”.
También se requerirá que “la documentación esté apostillada con copia de pasaporte y se declare la fecha programada del viaje”.
La medida también alcanza -detalla la norma- a “extranjeros no residentes que viajen por motivos de trabajo, negocios, estudios, capacitación, viajes oficiales de diplomáticos o funcionarios o por ser deportista y requerir participar de un evento deportivo y que manifiesten no contar con esquema completo de vacunación según criterio establecido por país de procedencia”.
Estas personas, al ingresar al país, deberán “presentar documentación que justifique el criterio invocado, ya sea carta del empleador, carta del invitante en el país, o de la contraparte comercial, carta oficial del organismo del Estado que envía al funcionario extranjero en misión oficial o constancia de inscripción en institución educativa o en congreso o invitación de la entidad deportiva que organiza el torneo internacional reconocido por el Ministerio de Transporte de Turismos y Deportes”.
También están comprendidos “los extranjeros a quienes se les otorgue un visado en categorías migratorias permanente o temporaria, que manifiesten no contar con esquema completo de vacunación según criterio establecido por país de procedencia”.
En todos los casos se deberá presentar copia de pasaporte y declarar la fecha programada del viaje y se verificará la visa otorgada.
Los extranjeros que formen parte de equipos deportivos “deberán contar con una certificación” de la entidad que representen y que acredite que viajan con motivos competitivos “a fin de que puedan exhibirla ante las autoridades competentes de ingreso al país y así eximirse además del requisito de cuarentena para su ingreso a Argentina”.
Además, la norma establece que “esta excepción podrá también reconocerse a los argentinos mayores no vacunados en las mismas condiciones y con los mismos requisitos”
La documentación que acredite las condiciones y requisitos referidos en esta Resolución “deberá ser portada por la persona que ingresa al país en todo momento, al menos durante los primeros 14 días de ese ingreso”.
Se dispone que “las personas extranjeras que por su función diplomática estén acreditados ante el Estado Argentino, para acceder a la excepción de la exigencia de vacunación Covid-19 con esquema completo, cuya última dosis se hubiera aplicado al menos 14 días antes de su ingreso al país, podrán tramitar” ante Cancillería “por única vez, una certificación consular” que los exceptúe de la restricción de ingreso al país.
Cuando en las solicitudes de excepción se invoquen motivos de salud, se dará inmediata intervención a las autoridades de la cartera sanitaria para que se evalúen “los antecedentes del caso por parte de sus áreas competentes”.
“Las consultas o solicitudes que eventualmente se efectúen, con carácter general o particular por la especificidad de la temática” definida por el Ministerio de Salud “deberán detallar la situación migratoria de la o las persona/s que motivan el requerimiento, así como cualquier otra circunstancia excepcional de las que surjan responsabilidades específicas asumidas por el Estado, derivados de esa condición para sus titulares”.
